Criminal Background Check Program (CBC)
Why do Criminal Background Checks?
Careful screening of staff and volunteers is an important step in risk management.
One tool which can be used in this process is criminal background history check. This background check is not necessary for every individual involved in an agency, but it does provide an extra measure of protection if an agency's volunteers or staff work directly with vulnerable clients.
Who can utilize the Criminal Background Check service?
In 1995, the Texas legislature granted Texas Volunteer Centers permission to conduct criminal background history checks on staff and volunteers of nonprofit agencies who provide services to clients with various vulnerabilities. The law states that these background checks can be done by the Volunteer Center for client agencies that "involve the care or access to: a child; an elderly person; or a person who is mentally incompetent, mentally retarded, physically disabled, ill or incapacitated."
Checks may also be done on volunteers or staff who will perform services in a residence or have access to money or confidential information.
How does an agency participate?
The Texas Department of Public Safety (DPS) regulates the CBC program and has approved the following steps for participation by nonprofit agencies:
Submit an application to the Volunteer Center.
Sign a CBC agreement.
Develop agency policies and procedures for screening and accepting volunteers and staff.
Obtain DPS approval (Volunteer Center applies on behalf of agencies).
Submit volunteer and staff names for a state criminal background check and determine the applicant's suitability based on your agency's criteria.
